All mediations are billed at $395.00 per hour, in 15 minute increments, divided equally among the parties unless otherwise agreed. (A minimum of two (2) hours will be charged per party for half day mediations and a minimum of four (4) hours will be charged per party for full day mediations).
We never charge an administrative or scheduling fee, however, in the event that you choose to send voluminous materials in advance of mediation, we reserve the right to bill our time for review at the above quoted mediation rate.
For Mediations that take place outside Downtown Miami/Brickell, travel time is billed at a reduced rate of $300 per hour divided equally among all parties. For Mediations outside our Miami Office, Parking Charges are divided equally among all parties. For Mediations that take place at a Court Reporter's office/business center or other location by whom we are charged, we shall pass through such charge to the parties without markup.
Counsel for the respective parties are responsible for timely payment of mediation fees and charges, WITHIN 10 DAYS OF MEDIATION. Checks should be payable to K & A Mediation. EIN #20-0979400.
If your mediation requires cancellation or rescheduling, we ask that you please provide us with as much advance notice as possible so that we have the opportunity to make your time slot available to others. Notwithstanding, a cancellation due to settlement or without the possibility of rescheduling, less than two (2) business days prior to the date scheduled for mediation will result in a charge equivalent to the 2 hour minimum divided equally between the parties.
Valet parking is available in and around The Historic Alfred I. Dupont Building. The garage entrance is on the north side of the building and is easiliy located through any electronic map service by inputting 170 NE 1st Street, Miami, Florida 33131. We do not validate parking. A less expensive open lot is also available on NE 1st Street across from the entrance to the Dupont Building's parking garage.
In the event that any of the participants have any special safety or health concerns, or other special needs, please advise our office prior to the date of mediation.
Confidentiality and Mediator Immunity:
In the event that the mediation is voluntary or other than a court ordered mediation, all participants acknowledge and agree that the mediation shall be conducted as though court ordered, and, therefore, all statutes and rules with respect to mediator immunity and mediation confidentiality apply. In the event that the parties agree to allow non-parties to participate, such as public adjusters, such non-party participants shall be bound by the same rules of confidentiality governing the parties.
